1. Definitions

For the purposes of these Terms:

• "Software" refers to the InputSwitcher macOS application, including all updates, upgrades, and documentation.
• "We," "Us," "Our" refers to the developers and operators of InputSwitcher.
• "You," "User," "Licensee" refers to the individual or entity using the Software.
• "Free Version" refers to the basic version of InputSwitcher with limited features.
• "Pro Version" refers to the full-featured version requiring a valid license key.
• "License Key" refers to the unique code provided upon purchase to unlock Pro features.

2. Acceptance of Terms

By downloading, installing, copying, or otherwise using InputSwitcher, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are using the Software on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must immediately stop using the Software and delete all copies from your devices.

3. License Grant

3.1 Free Version License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Free Version of InputSwitcher on any number of personal computers you own
• Use the Free Version for personal and commercial purposes
• Use the Free Version indefinitely without charge

3.2 Pro Version License

Upon purchase of a valid Pro license, we grant you:

• All rights included in the Free Version license
• Access to Pro features as described on our website
• The right to use the Pro Version on up to 3 personal devices simultaneously
• Access to priority support

3.3 License Scope

Both licenses are:

• Non-exclusive: We may license the Software to others
• Non-transferable: You may not transfer your license to another person
• Personal: Licensed to you as an individual, not sharing with others

4. Usage Restrictions

You agree NOT to:

• Modify or Adapt: Modify, translate, adapt, or create derivative works based on the Software
• Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Redistribute: Distribute, sublicense, lease, rent, loan, or otherwise transfer the Software to third parties
• Remove Notices: Remove, alter, or obscure any proprietary notices, labels, or marks
• Circumvent: Circumvent, disable, or interfere with any license verification mechanisms
• Share Keys: Share, publish, or distribute license keys
• Commercial Distribution: Include the Software as part of any commercial product or service without written permission
• Illegal Use: Use the Software for any unlawful purpose or in violation of any applicable laws

5. Pro License Terms

5.1 Device Limit

Each Pro license key may be activated on up to 3 (three) devices owned and controlled by the licensee. All devices must be for personal use by the same individual.

5.2 License Duration

Pro licenses are perpetual for the major version purchased. For example, if you purchase a Pro license for version 1.x, you will have access to all 1.x updates. Major version upgrades (e.g., 2.0) may require a new license or upgrade fee, which will be offered at a discount to existing customers.

5.3 License Verification

License keys are verified locally using cryptographic signatures. We do not require ongoing internet connectivity for license verification.

5.4 License Recovery

If you lose your license key, contact support with your original purchase email to recover it.

6. Payment & Pricing

6.1 Pricing

Pro license pricing is displayed on our website and may vary by region due to purchasing power parity. All prices are in USD unless otherwise specified.

6.2 Payment Processing

Payments are processed through secure third-party payment providers. We do not store credit card information on our servers.

6.3 Taxes

Prices may be exclusive of applicable taxes (VAT, GST, sales tax). You are responsible for any taxes applicable to your purchase based on your jurisdiction.

7. Refund Policy

7.1 Exceptions

Refunds may not be granted in cases of:

• Abuse of the refund policy (multiple refunds from the same user)
• Requests made after the 14-day period
• License keys obtained through unauthorized channels

8. Updates & Support

8.1 Software Updates

• Free Version users receive critical bug fixes and security updates
• Pro users receive all updates, including new features, for the licensed major version
• Updates are provided "as available" without guaranteed timelines

8.2 Support

• Free Version users have access to documentation and community resources
• Pro users have access to priority email support
• We aim to respond to Pro support requests within 48 hours

8.3 Discontinuation

We reserve the right to discontinue the Software at any time. If discontinued, existing licenses will remain valid, but no further updates will be provided.

9. Intellectual Property

InputSwitcher and all related trademarks, logos, designs, documentation, and content are the exclusive property of their respective owners and are protected by intellectual property laws.

• This license does not grant you any rights to our trademarks or branding
• You may not use "InputSwitcher" in any product names or marketing without permission
• All user feedback and suggestions may be used by us without obligation

10. Disclaimer of Warranties

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.

11. Limitation of Liability

Our total liability to you for all claims shall not exceed the amount you paid for the Pro license in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless InputSwitcher and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Software
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your infringement of any third-party rights

13. Termination

13.1 Termination by You

You may terminate this license at any time by ceasing to use the Software and deleting all copies.

13.2 Termination by Us

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:

• All rights granted to you will cease immediately
• You must stop using the Software and delete all copies
• License keys will be deactivated
• No refunds will be provided for termination due to breach

13.3 Survival

Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date
• For material changes, we will provide notice via email or the app
• Continued use of the Software after changes constitutes acceptance
• If you disagree with changes, you must stop using the Software
